Garry Malphrus

Garry D. Malphrus is a Board Member with the Board of Immigration Appeals. He was elevated to the Board on May 30, 2008. [1] From June, 2005 until his appointment to the Board, he was an Immigration Judge in Arlington, Virginia. [2]

Malphrus appointment as an Immigration Judge by Alberto Gonzales was highly controversial.[3] Despite having no prior immigration experience (and in violation of the Code of Federal Regulations which generally require at least five years experience), Gonzales appointed Malphrus. [4] Many alleged that the appointment was a result of Malphrus' political ties to the Bush Administration. [5] Prior to becoming an immigration judge, from 2001 to 2004, Judge Malphrus served as associate director of the White House Domestic Policy Council. [6] He was also reported to have been a member of the so-called Brooks Brothers Riot, the Republican orchestrated protests during the 2000 Presidential Election Florida Recount. [7]

As an Immigration Judge, Malphrus had a relatively high denial rate for political asylum claims. According to one study, Malphrus denied approximately 70% of all asylum claims, putting him in the top 1/3 of all immigration judges in terms of denial rates. [8] [9]

From 1997 until 2001, Malphrus served as Chief Counsel to the Senate Subcommittee on Criminal Justice Oversight under the pro-segregationist Senator Strom Thurmond. During this time, it was reported that Malphrus took several privately funded trips that were seemingly unrelated to his work on the Subcommittee on Criminal Justice, including a California "site visit for Netscape and Warner Brothers" paid for by Time Warner, a "fact-finding trip regarding Pitney Bowes" paid for by Pitney Bowes, and a golfing trip to Colorado where he spoke on a panel on judicial appointments, paid for by the American Bar Association.[10].
