- The image was published as an advertisement in the U.S. in the 1940s or 1950s. There is no evidence that copyright notice was originally filed on the image, as then required. For instance, this image evidently shows the entire advertisement and no copyright notice.
- A search of U.S. copyright renewal records reveals no evidence that WKIC or Mutual Broadcasting System or any asignee renewed copyrights to this advertisement or any collection of advertisements or any collection of material that might encompass this advertisement as would have been required to maintain copyright protection, if any.
- There is no evidence that WKIC, its owner—Mountain Broadcasting Inc.—or CBS Corporation, the corporate heir to Mutual Broadcasting System, claims copyright on the image.
