The inclusion of the image FullyLaminatedSleeve.jpg in the article Gramophone record is claimed as fair use because:

  1. It is a low resolution photograph of a minor portion of an album cover for the purposes of illustrating a particular packaging method ;
  2. It is a partial reproduction of the album cover and could in no way be mistaken for the complete artwork;
  3. The image illustrates a version of the cover artwork that is no longer commercially available and does not therefore infringe upon the rights of the current copyright holder or the commercial value of the recording itself;
  4. It does not limit the copyright owner's rights to sell the album in any way;
  5. Copies could not be used to make illegal copies of the album artwork;
  6. It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value;
  7. The image is only a small portion of the commercial product it illustrates;
  8. The use of the cover will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original;
  9. The use of the cover illustration is in good faith, and its inclusion enhances the quality of the articles without reducing the commercial value of the recording from which it was drawn.

The image is a photograph of the 1979 Topic Records album cover for Because It's There by Martin Carthy. The album is currently available on CD by Topic Records with different artwork and using a different packaging method.
