My rationale for fair use is to illustrate the article on the composer Cesare Pugni, who composed the music for the piece shown in the photograph, the article was made for educational purposes. The purpose that the photo serves is to illustrate a particular work discussed in the article, and no free equivalent photo exists of anything from this ballet, and none could be created that would adequately give the same information.
