Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

1. The image is used as the primary means of visual identification of the article topic.
2. The image illustrates an educational article for informational purposes. It represents the band at the very beginning of their career. It illustrates the membership of the band at the time.
3. The image is of a low resolution (300 x 190).
4. Since the band has now split up, it is not possible to replace the image with a new free alternative. No free or public domain images have been located to represent this subject. Other photos that survive from this time period in the band's history are copyrighted photos.
5. Use of this image does not diminish the copyright holders' ability to gain profit from the band's work. The photo has been widely used in newspapers and magazines as well as by media corporations such as the BBC. Use of the image enhances interest in the band, and is consistent with use of promotional imagery.
