Though the picture is subject to copyright I (Peregrinefisher) feel it is covered by the U.S. fair use laws because:

it is a low resolution still of a television episode;
it does not limit the copyright owners rights to sell the episode in any way;
it illustrates the episode in question and aids commentary on the plot outline.
this image was chosen because the episode is about a contagious disease, and this image shows Mulder and Scully dressed in clean suits because of this disease.
The copyright is most likely held by Fox Broadcasting Company.
