It is believed that this image failed under being fair use for the following reasons:

  • Atari has not released any screenshots into the public domain;
  • It serves to illustrate the game in question;
  • It serves to identify E.T., a well, a phone piece, and the action icons;
  • It is of low quality;
  • The image does not limit the copyright owners' rights to distribute the video game in any way;
  • The image is being used for informational purposes only;
  • Its use is not believed to detract from the original game in any way;
  • Its use does not infringe on Atari's ability to sell the game, which is old and hasn't been sold by Atari in decades.
  • Atari doesn't want it and has dumped it into a landfill. That's sorta like giving up copyright.
