Photograph of the East Side Playhouse, c. 1980. The building was demolished in the 1980s. Jerry Gotham (choreographer) and Raymond Allen (stage actor) are standing in front of the building.

The image qualifies for the fair use exception to the copyright laws because:

  • It is a low resolution image
  • The subject of the photograph, the East Side Playhouse, on E. 74rd St. in Manhattan was destroyed, and so the photo is a historic photo that cannot be replaced
  • The photo is being used to illustrate an educational article about the resident theatre company of the theatre, the Light Opera of Manhattan
  • Use of the image will not deprive the copyright holder of income
