This map is inaccurate -- all of the US should be coloured retentionist. This is because, even though some US states have abolished the death penalty under the law of that state, it is still practiced under US federal law, which is in force in every US state. Thus, every US state is in reality retentionist (of course, the state has no control over federal law, but thats part and parcel of the US being a nation-state with a federal system of government). --SJK 12:24, 21 July 2006 (UTC)
- Kansas is marked incorrectly. Kansas has not used the death penalty for a long time, however, it is by no means abolished.LH 18:59, 1 August 2006 (UTC)

- As for the supreme court case, it did not abolish the death penalty, it was only as to the application in that case and as to that law. Inmates were still on death row. Either way, that is moot with the recent supreme court case (Kansas v. Marsh) (June 26, 2006) LH 23:11, 2 August 2006 (UTC)
