Though the picture is copyright © to the BBC, I (Wolf of Fenric (talk) 05:41, 12 February 2008 (UTC)) feel it is covered by the U.S. fair use law because:

  1. The image is a low-resolution copy of a publicity photograph;
  2. The image is being used to identify a Dalek menacing the Third Doctor from the television serial Day of the Daleks;
  3. No free alternative exists;
  4. The use of the image in these articles will have no effect on the BBC's commercial use of the image in question.

Copyright undetermined This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit.

The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion.
