Image talk:Corona can.jpg

From Wikipedia, the free encyclopedia

This image was taken by myself, via Treo 700wx cell phone camera, of a can on a street corner. I can't reply to this "violation" because it isn't in English. Brianga 02:27, 20 August 2007 (UTC)

It's a copyright violation of the company design on the bottle. You can't change a license from copyrighted to GNU FDL, simply by taking a photo of the item. It is the same as with books, and photos and films, if they are copyrighted, you can’t make the copyright disappear by taking a photo of them, and releasing it under the GNU FDL. As a comparison, it's the same as making a bootleg by taking your video recorder into a theater and taping the film, the difference is you didn't mean to do anything bad. Jackaranga 10:22, 20 August 2007 (UTC)
I disagree. Copyright law states (and I'm paraphrasing) that an image which turns a three dimensional work into a two dimensional work is not covered by the original copyright, as the photographer has creative input. This is the same principal that applies to images of public domain work. The original work may be in the public domain, but the new image might not be. The new image is under the copyright of the photographer. - auburnpilot talk 15:09, 20 August 2007 (UTC)

I'll change it to IfD, as you have some valid points, and speedy deletion can only be used in uncontroversial cases. Jackaranga 16:25, 20 August 2007 (UTC)

Great. I've commented there and hopefully somebody with more knowledge on the subject can sort this out. - auburnpilot talk 16:49, 20 August 2007 (UTC)
