The most correct word should be used to describe this scheme in the prose.

This is not a fee because there is no service being offered.

This is not a penalty because the penalty is directly associated with the citation. Furthermore, a penalty is designed to be a deterrent, and as the prose clearly states, any deterrent effect of this tax is only a "side-benefit."

Several news articles clearly show that legislative intent is to increase revenue. Even the AAA was on record supporting this tax because it would offset increases in other taxes[1].

This is a tax. Call it what it is. Don't use the legislature's whitewashed langauge.
