Purpose of use

To show the importance of the subject profiled in the encyclopedic article as a leading NBC comedy talent. This caricature reflects the comedic nature of the subject and thus qualifies as fair use since the subject and his comedy is detailed in the critical commentary.
Replaceable?

Irreplaceable since only Berman was employed by NBC to provide humorous artwork of its major comedy stars. Only through artwork rather than photos could Charlie McCarthy be depicted as truly lifelike which is how the character was perceived by listeners.
