[edit] Fair use rationale for Turbo-folk

This image, Ceca raznatovic 36.jpg, is being linked here; though the picture is subject to copyright I (Zvonko) feel it is covered by the U.S. fair use laws because:

  1. it is a low resolution scan of a Huper newspaper page (originally published in Serbia in 1992);
  2. it does not limit the copyright owner's rights, should he/she decide on such course of action, to re-sell that particular, now 14 years old, newspaper issue or try to otherwise exploit it commercialy;
  3. the image depicted on the scan is a publicity photo (widely available at the time) of a well-known individual, meant to be distributed through the media. As such it is in no way unique to the newspaper from whose page this particular scan comes from;
however so far no one has done anything with it the fits the use requirements of fair use.Genidealingwithfairuse 08:13, 3 March 2006 (UTC)
