This image was scanned from: John Howard Hinton The History and Topography of the United States of North America, from the earliest period to the present time (1856, vol. II) between pp. 384 and 385

This engraving appears to have been done in about 1840, but there is no indication from the publisher that there are any editions earlier than this one.
It was engraved by Samuel Walker at Boston, and is similar to one on display at the Library of Congress' Capitol Building exhibit located at http://www.loc.gov/exhibits/us.capitol.

This applies to the United States, Canada, the European Union and those countries with a copyright term of life of the author plus 70 years.

Note that a few countries have copyright terms longer than 70 years: Mexico has 100 years, Colombia has 80 years, and Guatemala and Samoa have 75 years. This image may not be in the public domain in these countries, which moreover do not implement the rule of the shorter term.
