[edit] Fair use for Template:BMovie
This image is being linked here; though the picture is subject to copyright I (DCGeist) feel it is covered by the U.S. fair use laws because:
- it is a low resolution copy of a movie poster;
- it does not limit the copyright owner's rights to sell the film or poster in any way;
- copies could not be used to make illegal copies of the artwork on another poster; and
- the image is significant because it illustrates (a) a significant and representative 1970s B/exploitation movie, (b) a representative movie produced by the "King of the B's", Roger Corman, (c) a representative movie by a director who started in B pictures and graduated to A films, Jonathan Demme, (d) the marketing of such movies during the later history of Hollywood B movies, and (e) the contrast in representative genre and marketing with the earlier film whose poster is depicted in the template alongside it.
Note: The template is intended to appear only in those articles that are part of the B movie series—B movies (Hollywood Golden Age), B movies (Transition in the 1950s), B movies (The exploitation boom), and B movies (1980s to the present). It is believed that the image's fair use in the template is applicable to the template's use in the articles of this series alone.
This image is of a poster, and the copyright for it is most likely owned by either the publisher or the creator of the work depicted. It is believed that the use of scaled-down, low-resolution images of posters
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information. |
