[edit] Fair use for Jake Gyllenhaal

This image, Brokeback_mountain.jpg, is being linked here; though the picture is subject to copyright I, Francesco Franco aka Lacatosias feel it is covered by the U.S. fair use laws because:

  1. it is a low resolution copy of a movie poster;
  2. it does not limit the copyright owner's rights to sell the movie or poster in any way;
  3. copies could not be used to make illegal copies of the movie on a CD;
  4. the image on the cover is significant because it represents the artist in one of his roles discussed in the text.

[edit] Fair use rationale for Brokeback Mountain

  1. There is discussion of the poster, comparing it to the poster for Titanic (1997 film).
  2. The image is of lower resolution than the original poster (copies made from it will be of inferior quality).
  3. The poster is being used for informational purposes only, and its use is not believed to detract from the original film in any way.
  4. The poster's use in the article is entirely encyclopedic in nature.
