- it is the cover of a single edition of a long-running, now long-defunct magazine, featuring a historically significant story by a historically significant author;
- it is of much lower resolution than the original (copies made from it will be of very inferior quality);
- its use does not infringe on the ability of the copyright holder to sell or promote the magazine or image in any way;
- it is being used only for informational purposes; and
- its inclusion in hardboiled adds significantly to the article because it illustrates one of the most famous and seminal examples of the hardboiled detective, Sam Spade, in the inititation of his most famous hardboiled tale, The Maltese Falcon, in the definitive hardboiled magazine, Black Mask, as discussed in the accompanying text.
