- it is the cover of a single edition of a long-running, now long-defunct magazine, featuring a historically significant story by a historically significant author;
- it is of much lower resolution than the original (copies made from it will be of very inferior quality);

- it is being used only for informational purposes; and
- its inclusion in film noir adds significantly to the article because it illustrates a seminal hardboiled tale by one of the genre's most important authors, introducing the character that would evolve into Philip Marlowe, the definitive film noir private eye, as discussed in the accompanying text.
