Widely available, taken from [2] Fair use is being claimed because we don't know how to contact the copyright owner; there is no other way to obtain the photograph; it shows Bigley before the Tawhid and Jihad hostage photographs and is educational in that regard, showing him in a very different light; and it has no commercial value.
