I'm not sure who has been writing this history, but I'd like to correct some points of history. First, the early drafts of the new constitution originated in the work of Smith and Clayman when they were representatives, prior to Smith becoming student body president (in the 1995-1996 school year). The original draft died on the table, but several of its key elements, particularly editing the judicial process (mostly making the process smoother and the actors more independent and specifically addressing alleged sexual crimes), were passed as amendments under Smith's presidency. Later, additional amendments, particularly on budgetary issues, were passed during Tyler Kidd's presidency. During Clayman's presidency he and Robert Thomas, another Lamb student body president, began revisiting Smith's constitution and preparing it for passage during, if I remember correctly, Thomas' first term as student body president (I was in graduate school at the time). There were two key, notable differences between the Smith-Kidd-Clayman constitution worked out in the mid-1990s, however, and that which ultimately passed. First, the new constitution consolidated the Greek Council into the student government, effectively giving that body precedence over it - the previously devised constitution would have left the Greek Council independent but given it limited representation on the student government (I believe ex officio, but I'm not sure). Secondly, the Smith-Kidd-Clayman constitution was specifically and consciously anti-honor code - we held that an honor code represented a largely a window-dressing effort by the school, rather than a substantive change, particularly given that to attend Emory & Henry every student was already obliged to sign a statement which pledged them to academic honesty. . . I can say that these were the key differences of opinion between Robby Thomas and I on school government matters, unquestionably, though overall we regard our aims as very similar.
