My rationale for fair use is to illustrate the article on the ballet La Bayadere, which was made for educational purposes. In the article, a section is devoted to discuss a particular scene, formally known in the ballet as the Danse de Nikiya, as it was originally performed. The photo shows this particular scene being performed by the Ballerina Diana Vishneva, in its original form. No free equivalent exsists and none could be created that would give the same information.
