All persons are dead. The scene was accesed by police only due to the fact it was a crime scene. It illustrates the civil war that occurred at the time.

Given that its crown copyright there is limiting of commercial revenue by using the photograph.

The Copyright Act of 1976 sets out four factors to qualify for fair use:
1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes
-This photo is to be used to illustrate an atrocity. It is used in the History of Rhodesia article. It is for non commercial purposes.
2. the nature of the copyrighted work;
-It is Crown copyright.
3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole
-It is a low resolution image. The image used in the article is scaled down even further.
4. the effect of the use upon the potential market for or value of the copyrighted work.

-Since the photo can be distributed for free the distributing for free in Wikipedia does not negate its economic value.
