[edit] Summary
This is a photo illustrating the article, not the cover. From what I understand of fair use, this still qualifies. If that is incorrect, please leave a message on my User talk:Chidom page. Thanks.
Updated/additional information, in response to the message on my talk page:
- This image is from After Dark magazine: Butler, George, photographer. "Musclebound for Glory". After Dark, Danad Publishing Company, Inc., New York, NY, 98 pp. February 1977, p. 41.
- I believe it is fair use under the fair use policy because it meets it meets all of the criteria set out at Wikipedia:Fair use#Po;icy, as below:
- The photo is being used to illustrate a primary assertion of the Wikipedia article about the magazine in which it appeared; free material is not available and cannot be created. See After Dark (magazine).
- Use of the photo in Wikipedia will not replace its original market role. The magazine is no longer published; this low-res version of the image is not likely to be marketable, in any event. I believe its usage here doesn't infringe upon the photographer's ability to market the photo in a high-res version.
- This is a low-res image; the photo is the only example of its kind used for the article.
- Publication of the photo is cited above.
- I believe the photo is encyclopedic and meets general Wikipedia content requirements.
- I believe the photo meets the media-specific policy requirements.
- The photo is being used in the referenced article.
- The photo contributes significantly to the article—it is used to illustrate a relevant section in the article dealing with the magazine's homoerotic content; this is an illustration of that content.
- The photo is not being used outside the article namespace; it is used solely to illustrate the article.
- This description provides:
-
- Attribution of the source
- This fair use tag, which I believe to be appropriate under Wikipedia policy, as explained here.
- This constitutes the fair use rationale for use of the photo in the specific article in which it appears; it only appears in the one article.
Having carefully reviewed Wikipedia's policy, I believe this is sufficient. Thanks.—Chidom talk 00:02, 7 October 2006 (UTC)
