It is contended that the use of this image depicting a screenshot of a copyrighted television broadcse qualifies as fair use when used in NBA on ABC for the following reasons.

This image is copyrighted and therefore no free equivalent depiction of this exists.
The image is used to depict a particular aspect of the broadcast, in this example, the score strip displayed at the bottom of the screen.
This screenshot is of a much lower resolution than the original screen would have been itself.
This use of this screen shot is not expected to cause any financial damage to the copyright holder.
This screenshot is made for educational use and used for identification purposes in the article on NBA on ABC.
This screenshot demonstrates a unique feature/layout that could not be demonstrated using prose alone.
