It is contended that the use of this image depicting a screenshot of a copyrighted television broadcse qualifies as fair use when used in NBA on ABC for the following reasons.
- This image is copyrighted and therefore no free equivalent depiction of this exists.
- The image is used to depict a particular aspect of the broadcast, in this example, the score strip displayed at the bottom of the screen.
- This screenshot is of a much lower resolution than the original screen would have been itself.
- This use of this screen shot is not expected to cause any financial damage to the copyright holder.
- This screenshot is made for educational use and used for identification purposes in the article on NBA on ABC.
- This screenshot demonstrates a unique feature/layout that could not be demonstrated using prose alone.
- Wikipedia is a non-profit organization
