  • 備考:違法なja:肖像権侵害には該当しないと考え、顔にぼかしなどの画像処理は施しませんでした。なぜなら、撮影目的が百科事典の掲載のためという正当なものであり、人の多い公の場で演舞しているところを撮影したものであるということ、撮影の態様も問題なかったこと、TVカメラによる撮影が現に行われており、被撮影者は撮影されることを許諾していると推定されること、さらに、当時ja:YOSAKOIソーラン祭りの記事には写真が一枚も掲載されておらず、写真を掲載する合理的必要性があったこと、などの事情を総合的に勘案し、被撮影者の人格的利益の侵害が社会生活上受忍限度を超えるものとはいえないと考えたからです。
